What Is the USDA "And Justice for All" Poster?

The "And Justice for All" poster is a civil rights and nondiscrimination notice issued by the U.S. Department of Agriculture.

The notice informs individuals about USDA civil rights protections, prohibited discrimination, accessibility and language assistance, and procedures for filing a USDA program discrimination complaint.

Who Must Display the "And Justice for All" Poster?

Posting requirements depend on the USDA agency, program, funding arrangement, and type of organization involved.

Depending on the applicable program, organizations that may be required to display an appropriate "And Justice for All" poster can include:

  • USDA offices and facilities
  • Organizations administering USDA federally assisted programs
  • Recipients of certain USDA grants and cooperative agreements
  • Nutrition assistance program locations
  • Land-grant institutions participating in applicable USDA programs
  • Other organizations required by USDA program rules or award conditions to provide the notice

What Civil Rights Does the USDA Poster Explain?

The "And Justice for All" poster communicates USDA nondiscrimination protections applicable to the particular program covered by the notice.

Depending on the USDA program and applicable version of the poster, protected bases may include:

  • Race
  • Color
  • National origin
  • Sex
  • Age
  • Disability
  • Reprisal or retaliation for prior civil rights activity
  • Other characteristics protected under applicable USDA program requirements

Not every prohibited basis necessarily applies to every USDA program. Organizations should use the current poster prescribed for the program they administer.

Which "And Justice for All" Poster Version Do I Need?

USDA maintains different versions of the "And Justice for All" notice for different programs and activities. Organizations should determine which current AD-475 series poster applies to their particular USDA program.

Current USDA materials include versions for federally assisted programs, federally conducted programs, and certain program-specific civil rights requirements.

Employers and program administrators should not select an "And Justice for All" poster solely by its historical color designation. The appropriate current USDA form number and program requirements should be verified before posting.

Federally Assisted USDA Programs

Recipients administering applicable federally assisted USDA programs may be required to display the current "And Justice for All" assisted-program poster in locations where program participants and customers can readily see it.

Organizations should review the requirements of the USDA agency providing the funding or assistance to determine the correct poster version and display requirements.

Federally Conducted USDA Programs

USDA also maintains an "And Justice for All" notice for applicable federally conducted programs. USDA offices and facilities should follow their agency's current civil rights guidance when determining which notice must be displayed.

Federally conducted and federally assisted programs should not automatically be assumed to use the same poster version.

Where Should the "And Justice for All" Poster Be Displayed?

When required, the appropriate "And Justice for All" poster should be displayed prominently where customers, program participants, beneficiaries, and other affected individuals can readily see and read it.

Depending on the program, appropriate locations may include:

  • Customer service areas
  • Program offices
  • Reception and waiting areas
  • Nutrition program locations
  • USDA program administration offices
  • Educational or outreach facilities
  • Other locations where USDA-funded or USDA-administered services are provided

What Size Must the "And Justice for All" Poster Be?

Current USDA guidance for applicable "And Justice for All" notices specifies an 11-inch wide by 17-inch high display size.

The required size helps ensure that the civil rights information remains legible and accessible to program participants and customers.

Language and Accessibility

USDA civil rights requirements include provisions addressing meaningful access to program information for individuals with limited English proficiency and individuals with disabilities.

Depending on the program and population served, organizations may need to provide program information in languages other than English or provide alternative means of communication such as large print, Braille, American Sign Language, or other accessible formats.

How Can Someone File a USDA Program Discrimination Complaint?

Individuals who believe they experienced prohibited discrimination in a USDA program may submit a program discrimination complaint using procedures established by the U.S. Department of Agriculture.

USDA provides the AD-3027 Program Discrimination Complaint Form for submitting applicable complaints. Individuals may also provide the required complaint information through other methods permitted by USDA.

The applicable "And Justice for All" notice provides current information explaining how individuals can contact USDA regarding civil rights concerns and program discrimination complaints.

Is the "And Justice for All" Poster Required?

Yes, when required by the applicable USDA program, agency, award, or civil rights requirements. USDA offices and recipients of certain federally assisted USDA programs must display the appropriate current "And Justice for All" notice where affected customers and program participants can readily see it.

However, this is not a universally required federal labor law poster for every private employer. The requirement is tied to applicable USDA programs and activities.

Organizations should determine which USDA program requirements apply and use the correct current AD-475 series poster.

Keep the USDA Civil Rights Poster Current

USDA periodically updates its civil rights notices, nondiscrimination language, complaint information, and AD-475 poster versions. Organizations should periodically verify that the poster displayed at their facility is the current version required by the USDA agency or program they administer.

When USDA issues a revised poster for an applicable program, organizations should follow the agency's instructions regarding replacement of older notices.
